What is the Procedure to Get Bail in India? | By Ishan [Hindi] For Bailable Offences - the accused will be allowed to apply for bail immediately. Instant Bail shall be on Furnishing the bail amount. For Non-Bailable offences - the accused may have to wait for 48 hours to claim his or her right in the court. Hearing in the Court A bail hearing is not a hearing on the merits of the matter itself and does not go into the issue of guilt. Therefore granting of bail is the norm except in cases where specific grounds are made out based on which the bail can be refused. The granting of bail is usually considered to be an inherent right. However, there are certain circumstances where bail may be refused – these are related to Non Bailable Offences. In non-bailable offences accused may be granted bail if competent authority deems it fit. The relevant circumstances should be presented to show to the Court that bail would not harm further process of trial and justice. The amount the accused may have to deposit with the court will be at the discretion and decision of the judge. For certain smaller crime cases, a standard amount is set by convention and practice which needs to be deposited for awarding the bail. Otherwise in the interests of Justice. How to Become a CID Officer in Hindi | By Ishan In order to become a CID officer, you are required to crack the SSC Combined Graduate Level Examination which is conducted every year by Staff Selection Commission. For this you must be graduate in any discipline. Your age must be with 18-27 years. You should be Indian national. First you have to crack Tier I exam and thereafter Tier II exam and lastly skill test/interview. The Criminal Investigation Department is a crime detection agency under the Government of India. It was established on the 1st of April 1906. Those officers who work in this elite agency are known as Detectives or as CID officers. The agency also has some other divisions. They are the Finger Print Bureau and the Crime Investigation Bureau in addition to the scientific section. Qualifying exam: Candidates who wish to join the Crime Investigation Department must appear in the Indian Civil Services examination that is held by the Union Public Service Commission. The detail information regarding the exam and its syllabus will be available in all leading publications. Who is eligible to apply?: There are many posts available for candidates in the CID. Their level of entry is determined by their qualification. The minimum qualification required for a candidate to join as a constable in the CID is a pass in class 12. If one aspires to join as a Sub Inspector, he/she should have cleared graduation. Graduation is the requirement for officer level post as well. There are many universities in India that offers courses in criminology. The basic qualification for this course is a pass in class 10+2 with a milieu in arts or science. For those candidates who have a background in law, special courses in criminology are available. How to prepare for exam and interview?: Candidates who aspire to join the CID must have certain basic skills. An ability to analyze materials at a glance will be very helpful in the job. In addition to this, the candidates must also have excellent communication skills and a pleasing manner. They should also be attuned to the current happenings in the society. Those candidates who are interested in reading can refer to crime novels or autobiographies of well known personalities. Why Rent Agreements are Usually of 11 Months Only | By Ishan [Hindi] If you have ever put a property on rent or have lived in a rented house, you must have signed a rent agreement. Have you ever wondered why most rent agreements are for a duration of 11 months? Often, neither landlords nor tenants and not even the real estate agents know why this is so. Let’s find out. The rent agreement: Also known as a lease agreement, the rent agreement is a written contract between the owner of a property (the landlord) and the tenant who takes it on rent. The agreement specifies the terms and conditions based on which the property is let-out, such as: description of the property (address, type and size), monthly rent, security deposit, purpose for which property can be used (residential or commercial), and duration of the agreement. Its terms and the conditions can be negotiated but after it is signed, it is binding on both the landlord and tenant. It also specifies the conditions under which the agreement can be terminated. Why 11 months: Most rent agreements are signed for 11 months so that they can avoid stamp duty and other charges. According to the Registration Act, 1908, the registration of a lease agreement is mandatory if the leasing period is more than 12 months. If an agreement is registered, stamp duty and registration fee needs to be paid for it. For instance, in Delhi, for a lease of up to five years, the stamp paper cost is 2% of the total average annual rent of a year. Add a flat fee of Rs100, if a security deposit is part of the agreement. For a lease of more than 5 years but less than 10 years, it is 3% of the value of the average annual rent of a year. For 10 years and more but less than 20 years, it is 6% of the value of average annual rent of a year. The stamp paper can be in the name of the tenant or the landlord. In addition, a flat registration charge of Rs1,100 is also to be paid by demand draft (DD). If a property is let out for 24 months at a monthly rent of Rs20,000 for the first 12 months and Rs22,000 a month for the subsequent 12 months. The charges for registering this agreement would be: 2% of the average rent for 12 months: Rs5,040, (average monthly rent is Rs21,000, average annual rent is 21000*12 and 2% of that is Rs5,040). Plus if the agreement includes a security deposit, add another Rs100 and Rs1,100 as registration cost—bringing the total cost to Rs6,240. This is not counting the professional fees due to lawyers or other intermediaries for all the paperwork. It is to avoid paying these charges that many landlords and tenants mutually agree to not get the agreements registered. Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989 in Hindi | By Ishan The Scheduled Castes and Tribes (Prevention of Atrocities) Act, 1989 is an Act of the Parliament of India enacted to prevent atrocities against scheduled castes and scheduled tribes. The Act is popularly known as POA, the SC/ST Act, the Prevention of Atrocities Act, or simply the Atrocities Act. Article 17 of Indian Constitution seeks to abolish 'untouchability' and to forbid all such practices. It is basically a "statement of principle" that needs to be made operational with the ostensible objective to remove humiliation and multifaceted harassments meted to the Dalits and to ensure their fundamental and socio-economic, political, and cultural rights. This is to free Indian society from blind and irrational adherence to traditional beliefs and to establish a bias free society. For that, Untouchability (Offences) Act 1955 was enacted. However, lacunae and loopholes impelled the government to project a major overhaul of this legal instrument. From 1976 onwards the Act was revamped as the Protection of Civil Rights Act. Despite various measures adopted to improve the socio-economic conditions of the SCs and STs they remain vulnerable and are subject to various offences, indignities and humiliations and harassment. When they assert their rights and against the practice of Untouchability against them the vested interest try to cow them down and terrorize them. Atrocities against the SCs and STs, still continued. What does this law do?: This law does three things: 1.It punishes crimes against people belonging to Scheduled Castes and Tribes. 2.It gives special protections and rights to victims. 3.It sets up courts for fast completion of cases. What sorts of crimes are punished? 1.Some crimes under the IPC are given increased punishments under this law. 2.Cruel and degrading crimes that occur very often against SC/ST communities, such as forcing them to eat cowdung, boycotting them socially etc. More than 20 such acts are punished under this law. Do you have to have a caste-based intention to be punished under this law?: That is, do you have to commit the crime because someone belongs to an SC/ST? In most cases, a caste-based intention does not have to be proved. That is, it does not have to be proved that the accused person committed the crime for the reason that the victim belonged to a Scheduled Caste or Tribe. Protection Of Life And Personal Liberty: No person shall be deprived of his life or personal liberty except according to procedure established by law. Temple art or nakedness of sadhus are traditionally outside the purview of this section Whoever, to the annoyance of others: 1.does any obscene act in any public place, or 2.sings, recites or utters any obscene song, ballad or words, in or near any public place, shall be punished with imprisonment of either description for a term which may extend to three months, or with fine, or with both. Case Law 1.Dismissing a complaint that Richard Gere had acted obscenely by kissing Shilpa Shetty in public, the Supreme Court of India had observed that in this issue 'no case was made out'. 2.Even after this verdict, complaints have been filed in courts claiming that kissing in public constitutes an offense under this section.Kiss of Love Protesters were threatened with lawsuits under this section. 3.The Kerala High Court had observed that the performance of cabaret dance devoid of nudity and obscenity, judged according to the standards indicated was permissible, and was not in any way liable to be banned or prevented. 4.Quashing a case against 13 men who were arrested for allegedly indulging in obscene acts with women in a flat, the Bombay High Court has said any such action done in a private place is not a criminal offence under the Indian Penal Code. Narco Test Explained in Hindi | By Ishan In Narco (Narcoanalysis) test, the person is injected with 'truth serums' that cause the person to become uninhibited and talkative. It is still possible for people to lie under the influence of truth serums, so it is not altogether reliable. What is used for these tests is Sodium Pentothal, which sedates only for a few minutes. Drugs like Sodium Amytal and Scopolamine are also used. Though the court may give limited admissibility depending on the case, but these tests do not have any legal validity as confessions under article 20(3) of Indian constitution which prevents self incrimination. A person is able to lie by using his imagination. In the Narco Analysis Test, the subject's imagination is neutralised by making him semi-conscious. In this state, it becomes difficult for him to lie and his answers would be restricted to facts he is already aware of. Experts inject the subject with Sodium Pentothal or Sodium Amytal. The dose is dependent on the person's sex, age, health and physical condition. A wrong dose can result in a person going into a coma, or even death. The subject is not in a position to speak up on his own but can answer specific but simple questions. The answers are believed to be spontaneous as a semi-conscious person is unable to manipulate the answers. Status of Narco test in India: India's Central Bureau of Investigation has used intravenous barbiturates for interrogation on down cases like Kasab. On May 5, 2010 the Supreme Court held that narco, polygraph and brain mapping tests to be allowed after consent of accused. What is a Trademark?: A Trademark generally refers to a “brand” or “logo”. Trademark registration can also be obtained for a business name, distinctive catch phrases, taglines or captions. Properly used and promoted, a Trademark may become the most valuable asset of a business. Trademarks such as Coca Cola, HP, Canon, Nike and Adidas serve as an indication of origin of the goods as well as an indication of quality. It is also essential to obtain trademark registration for the business name/trade name under the Trademarks Act. Registration of a company or business name under the Companies Act does not in itself give protection against others who might commence using identical or similar marks. The clarification follows a July 2017 Supreme Court order which said that a driver’s license was sufficient to operate a light motor vehicle and that a separate endorsement was not needed. “The requirement under the Motor Vehicles Act, 1988, to obtain the transport licence would arise in case of medium/ heavy goods and passenger vehicles only. No other vehicle will require any separate endorsement, even if they are used for commercial purposes,” said the advisory issued on April 16. The exemption is in place for motorcycles without gear, motorcycles with gear, light motor vehicles (goods/passenger) and e-rickshaws/e-carts. Rajendra Soni, general secretary, Delhi Auto Rickshaw Sangh and Delhi Pradesh Taxi Union, welcomed the move. “This will simplify our lives. Earlier, after getting a private license we would have to wait for a year before we could apply for a commercial license. Moreover, because of corruption we would have to spend anywhere between ₹20,000 to ₹30,000 to get a commercial license.
