For the second podcast, I prepared a thirteen step overview of settling an estate in case you ever get asked to be someone’s executor of estate (or, if your prefer the modern term, personal representative). The probate process is a creature of state law that is mostly governed by each state’s statute, so it’s not an exaggeration to say that every state is different--the steps of administering an estate in California will have way different requirements than Texas. Still, there are general steps that are generally followed in all states, and I provided a twenty minute overview of what the process entails if you’re interested in getting the lay of the land for administering someone’s estate. #1. Funeral Arrangements #2. Find the will, identify assets, protect against theft and conversion, tally expenses #3. Determine probate assets vs. non probate assets #4. Petition to probate court, usually to admit the will into probate (standard form documents)...if no will, petition for administration and appointment of representative #5 The Will must be “proved” #6 The court will sign an order admitting the will to probate and issue a Letters Tesamentary to the executor--this is a grant of authority to pay bills and distribute the assets #7. Most wills waive the bond, so no need to guarantee performance #8. Formal or Informal: If formal, court supervision. If informal, inform at completion. Universal succession--automatic title grant, obligation to pay creditors. #9. Formal: Assets are put on inventory sheet for the court--appraisal may be required. #10. Collect all assets, and call up and use Letters Testamentary if necessary. Establish a new bank account: “Executor for the estate of ____________” transfer all property to this account. Sell the car, write the check for “Estate of ___________” ….pay debts, attorney fees, and other expenses. #11. “Holding period” --assets get assembled, creditors get to file claims. Is it valid or not? If valid, pay it up. Otherwise, tell them to go to the judge. #12. During holding period, gauge tax liability. Estate, inheritance, and death taxes. If yes, file returns and pay taxes. Gotta sell the car to pay the tax bill? Do it. If family allowance request, take it to the judge. #13. Then, you tell the judge you’re ready to disburse, and he’ll approve. Notice: This article, which I believe may be of interest to readers, is for general information and entertainment purposes only. If you don't currently have a will, your loved ones may not receive the assets you wish to leave them in the event of your death. If you're unsure of where to start, the next 30 minutes will provide you with the basic information you need to know when you're considering making a will. What Is a Will? A will is a legal document that sets forth your wishes regarding the distribution of your property and the care of any minor children. Wills come in several varieties, including the following: Self-Proving/Testamentary Will A self-proving will, also know as testamentary will, is the traditional type of will with which most people are familiar. It is a formally prepared document that is signed in the presence of witnesses. Holographic Will Holographic wills are written without the presence of witnesses. They rarely hold up in court. Oral Will Oral wills are spoken testaments given before witnesses. They are not widely recognized from a legal perspective. Living Will A living will has nothing to do with the distribution of assets, but rather sets forth your wishes for medical care in terms of life support should you be incapacitated. To maximize the likelihood that your wishes are carried out, you want a will that is set forth in writing, and signed by you and your witnesses. If your will does not meet these standards, your instructions may not be carried out. Why Do I Need One? Creating a will gives you sole discretion over the distribution of your assets. It lets you decide how your belongings, such as cars or family heirlooms, should be distributed. If you have a business or investments, your will can direct the smooth transition of those assets. If you have minor children, a will lets you provide for their care. If you have children from a prior marriage, even if they are adults, your will can dictate the assets they receive. Creating a will also minimizes tensions between survivors. Relatives battling over your possessions can weaken what may have otherwise been a strong family. If you are charitably inclined, a will lets you direct your assets to the charity of your choice. Likewise, if you wish to leave your assets to an institution or an organization, a will can see that your wishes are carried out.

The first step's here is for the son/ daughter to apply as a legal heir through the tax website to the department and then (2) Step 2 - Enter the site using deceased site credentials and file return on their behalf as a legal representative Here we see how step 1 is done Solution - By Amlan Dutta Say , deceased Assesse - Ram Pratap Kumar Previous year - 2013 14 Assessement year - 2014 15 Son - Vinod Kumar Death - Due to Masssive cardiac arrest on 04/7/2013 Here , first the death certificate obtained from both hospital and the municipal corporation has to be send to the assessing officer so that no further notices are sent to the deceased in future .Also pan card of the deceased (Ram ) needs to be surrendered to the IT department Second , most important , please note Vinod Kumar , son (and legal heir assumed ) has to register in income tax website with his login credentials and first register as legal heir See the tutorial to make this part clear Here , vinod will go to field registyer as legal heir and fill in the details for the deceased employee You will see there are various fields for giving details of the deceased , like the name , date of birth , surname , middle name , first name etc So , Vinod will first fill this up , Details of the Deceased Name of the deceased - Ram Kumar Date of Birth - (Late Ram's DOB) 11/06/1960 Surname - Kumar Middle name - Pratap Last Name - Kumar Then to further proceed on with the request a checklist of documents need to be submitted which are namely , (1) Death certificate of Ram (2) Ram's Pan card (3) Self attested Pan card Copy (I.e pan card of Ram signed over by son Vinod) (4) Legal Heir Certificate (5) Affidivait in presence of notarised public All the above documenst needs to be scanned and zipped and then uploaded (Look at the atached pic ) Once , Vinod does all this and submit's request for Legal heir , the request is then processed by the department In few week's Vinod will get a confirmation for legal heir And now , Vinod will login to his Income tax id website using the login credentials of the deceased for the previous year 2013 14 (Assessment year 2014 15 ) or for all years where the return needs to be filed if such be the case (All income and tax details can be easily made available using for 26 AS in the income tax website for the deceased and this can be used by the legal heir to understand the source of income and TDS deducted if he has no other sources to determine income heads and taxes paid ) Let's assume that Late Ram had income just from salary and Axis bank FD ) for the previous year 2013 14 So , his selection for return would be ITR 1 if one goes by income heads But here the return is being filed by the legal representative (see attached picture ) This is not availablein ITR 1 So Vindo will have to file ITR 2 for Late Ram and select the option " Return being filed by legal representative " Name of the representative - Vinod Address of the representative - Vinod's address B 191 , Jolly maker -1 , Cuffe parade , Mumbai PAN of the representative - Vinod's PAN - AIJPD5871R So Vinod will fill the return details (ITR 2 ) for late father Ram and declare all sources of income and taxes paid as can be figured out from form 26 AS AS WELL Then depending upon whether the case is due for refund or otherwise , the return is supossed to be submitted Once done and the return is uploaded , Vinod will get acknowledgement (ITR V )for return filed for his father (Late Ram Pratap singh ) He needs to send the acknowldgement for this to the department Please , note that Vinod, for filing his own return (ITR 1/2/3/4 as the cas emay be ) will login to the income tax website using his own credentials and will file his return which is separate Note this will just happen once in everyone's life I explain this in detail because i know billions of lifes will eb effected by this both in good manner because of the transparency of the process but also in a negative manner because of the loss of someone precious in life Hopefully , all of you can bless me , Civil Engineer Amlan Dutta - Founder of Make Knowledge Free

(amended 2005) Devolution of interest in coparcenary property.- (1) In a Joint Hindu family governed by the Mitakshara law, the daughter of a coparcener shall,- (a) be coparcener (by birth) same as son; Partition before 20th day of December, 2004, stand. partition duly registered under the Registration Act, 1908’. (3) Joint Hindu family property under Mitakshara law, shall devolve by testamentary or intestate succession, and not by survivorship. (a) the daughter is allotted the same share as is allotted to a son; (b) the share of the pre-deceased coparcenar, shall be allotted to his (her) surviving child (or grand-child); and (4) no court shall recognise pious obligation of son against debt of his father (or grandfather)t: 7. Devolution of interest in the property of a tarwad, tavazhi, kutumba, kavaru or illom 8.General rules of succession in the case of males intestate succession: (a) Only to Class 1 heirs (if any); specified in schedule; (b) Else, if no alive class 1 heir, then relatives specified in class II (Schedule); (c) Else, if there is no heir of classes I or II, then upon the agnates of the deceased; and (d) lastly, if there is no agnate, then upon the cognates of the deceased. 9. Order of succession among Class of heirs: Those in class I shall take simultaneously and to the exclusion of all other heirs; Those in the first entry in class II shall be preferred to those in the second entry; those in the second entry shall be preferred to those in the third entry; and so on in succession. 10 Distribution of property among heirs in class I of the Schedule: Rule 1-The intestate’s widow, or if there are more widows than one, all the widows together, shall take one share. Rule 2-The surviving sons and daughters and the mother of the intestate shall each take one share. Rule 3-The heirs in the branch of each pre-deceased son or each pre-deceased daughter of the intestate shall take between them one share. Order of succession among agnates and cognates Rule 1- Of two heirs, the one who has fewer or no degrees of ascent is preferred. Rule 2- Where the number of degrees of ascent is the same or none, that heir is preferred who has fewer or no degrees of descent. Rule 3- Where neither heirs is entitled to be preferred to the other under they share equally. 13. Computation of degrees (3) Every generation constitutes a degree either ascending or descending. 14. Property of a female Hindu to be her absolute property any such property held by her as stridhana immediately before the commencement of this Act. 15. General rules of succession in the case of female Hindus (1) The property of a female Hindu dying intestate shall devolve according to the rules set out in section 16 : (a) firstly, upon the sons and daughters (including the children of any pre-deceased son or daughter) and the husband; (b) secondly, upon the heirs of the husband; (c) thirdly, upon the mother and father; (d) fourthly, upon the heirs of the father; and (e) lastly, upon the heirs of the mother. (2) For property inherited by a female Hindu (a) from her father or mother shall devolve, in the absence of any son or daughter of the deceased; upon the heirs of the father; and (b) any property inherited by a female Hindu from her husband or from her father-in-law shall devolve, in the absence of any son or daughter of the deceased; upon the heirs of the husband. 16. Order of succession and manner of distribution among heirs of a female Hindu Rule 1- those in one entry shall be preferred to those in any succeeding entry and those including in the same entry shall take simultaneously. Rule 2- the children of predeceased child of intestate shall take between them the share which such child would have taken if living at the intestate’s death. GENERAL PROVISIONS RELATING TO SUCCESSION 19. Mode of succession of two or more heirs If two or more heirs succeed together to the property of an intestate, they shall take the property- (a) save as otherwise expressly provided in this Act, per capita and not per stripes; 20. A partition is a term used in the law of real property to describe an act, by a court order or otherwise, to divide up a concurrent estate into separate portions representing the proportionate interests of the tenants. Under the common law, any tenant who owns an undivided concurrent interest in land can seek such a division. In some cases, the parties agree to a specific division of the land; if they are unable to do so, the court will determine an appropriate division. A sole owner, or several owners, of a piece of land may partition their land by entering a deed poll. There are three kinds of partition which can be awarded by court: partition in kind, partition by allotment, and partition by sale. A partition in kind is a division of the property itself among the co-owners. Partition in kind is a default method of property partition. In a partition by allotment, which is not available in all jurisdictions, the court awards full ownership of the land to a single owner or subset of owners, and orders them to pay the person or persons divested of ownership for the interest awarded. Partition by sale constitutes a forced sale of the land, followed by division of the profits thus realized among the tenants. Generally, the court is supposed to order a partition sale only if the land cannot be physically divided, although this determination often rests on whether the economic value of the divided pieces is less in the aggregate than the value of the parcel as a single piece.
