A Chapter 7 bankruptcy is the most common bankruptcy filed. Chapter 7 bankruptcy eliminates most debts such as credit cards, medical bills, judgments, mortgage deficiencies, collection accounts, and many other debts. The elimination of debt through bankruptcy is called a “discharge,” which means you are no longer obligated to pay the debt. Filing Chapter 7 bankruptcy eliminates all debts except student loans, child support, overdue taxes from the past three years, and court-ordered restitution. The biggest benefit of filing Chapter 7 bankruptcy is that it only takes 90 days to finish. It’s one of the quickest debt relief options available. Chapter 7 bankruptcy is known as a “liquidation bankruptcy” because the Chapter 7 bankruptcy court appoints a “trustee” who can sell or “liquidate” your unprotected assets and use the sale proceeds to pay your creditors. The nice thing about Chapter 7 bankruptcy is that you know which assets are protected and which are not before you file. In most states, you can often keep your car, home, clothing, jewelry, household items, and 100% of retirement accounts. The property you get to keep after filing for bankruptcy depends on your state’s “exemptions”. Each state has an exemption law that delineates the type and amount of property a debtor can keep away from his creditors. All states allow you to keep 100% of your retirement accounts. Your rights to receive certain benefits, such as social security, unemployment compensation, veteran's benefits, public assistance, and pensions are completely exempt regardless of the amount received. No one can take away those future benefits if you file bankruptcy. Bankruptcy protects cars and homes depending on the amount of equity held in the property. What happens if you are above the exemption amounts or you have unprotected assets? In Chapter 7 bankruptcy, the trustee has the right to sell the property and disburse the proceeds to your creditors. Some trustees allow the debtors to buy back the items from the trustee. Another option is to sell unprotected assets before you file for Chapter 7 bankruptcy. Many Internet postings advise against selling any property before filing for Chapter 7 bankruptcy as it may be seen as keeping an asset out of the hands of a trustee. However, anyone can sell property before filing for Chapter 7 bankruptcy so long as the asset is sold at fair market value. If you do sell an asset prior to filing for Chapter 7 bankruptcy, and assuming it was at fair market value, the next question you have to answer is, “what did you do with the money?” This is where people get into trouble. Some people will sell the car at fair market value and then give the money to their father to repay a loan from him. That is a preference payment the trustee can recover. Your father would have to return the money to the trustee. Instead, invest the proceeds in a retirement account, pay your taxes, or spend it on personal needs. Some people fear Chapter 7 because they worry the trustee will sell their home and other assets even though it rarely happens. The latest statistic from the U.S. Trustee Program with the Department of Justice, which is the federal agency that oversees bankruptcy cases and trustees, is that only 5% of Chapter 7 cases have any assets that can be sold. This means 95% of the people who file for Chapter 7 bankruptcy do not lose anything. Chapter 7 bankruptcy is a powerful way to get out of debt, and with all powerful tools, there are some restrictions. In October 2005, the bankruptcy reform laws were revised with a new requirement: a “means test.” This test evaluates your income to determine if you are eligible to have your debts dismissed completely under Chapter 7 or whether you need to enter into a debt restructuring plan under Chapter 13. You may qualify to file Chapter 7 bankruptcy if your income falls below the median income in your resident state based on your family size. For example, in Colorado, if you are a single person who makes less than $50,000 per year, then you can file for Chapter 7. If you earn more than the median income, you may still qualify for Chapter 7 provided you are unable to set aside at least 25% of your income to repay your creditors. If you don’t qualify for Chapter 7, it doesn’t mean you cannot file bankruptcy as there are two other bankruptcies available. Surrendering your car means giving your car up and taking your discharge against your debt. Redeeming your car means paying the fair market value of the car within 30 days of the meeting of creditors. Most debtors don’t have the ability to do this because they cannot afford it. Reaffirmation means re-obligating yourself to continue paying the debt, meaning you won’t get to discharge that debt in your bankruptcy. Under Chapter 7 bankruptcy, many — in most cases, all — of your debts will be discharged. That means you will not have to repay them. However, if you want to keep property like a home or a car but are behind on the payments, a Chapter 7 case may not be the right choice for you. Unfortunately, certain types of debt are not dischargeable under bankruptcy. A few examples include obligations to pay spousal support (alimony), child support, student loans, most taxes, and debts that result from your causing death or injury, either willfully and maliciously, or while under the influence of drugs or alcohol. Hi Everyone. please open for more of an explanation if no questions have been answered in this video or BELOW (all about loans below) then please feel free to email me at; briisytchoice@gmail.com The past two-three videos are a lot different then normal. which i will be going back to the regular scheduled programs ( Makeup) i just wanted to make some videos that possibly all of you can relate too. i do not want to be singled to one section (i am an OPEN BOOK OF KNOWLEDGE) Bankruptcy lasts 7-10 years on your credit report.. my lawyer said 7 but some will say 10. a judgement is on your credit report indefinitely for 10 years and you are VERY VERY limited to what loan you could be eligible for, if any. with a bankruptcy on your report, its a bit different, because their are so many people filing a lot of the loan companies do not mind yet hike up the interest rate.one of my good friends' whom filed a year before me, just got approved for her first car all by herself being signed. a home loan is a bit different. my lawyer recommended to wait a couple years and to go to a certified place that will accept previous bankruptcy (bankruptcy approved), which most( 90-98%) banks do. she also explained, to get a secured credit card or unsecured credit card that has a low limit ($300 or so) and MAKE SURE to pay it off before the due date. if i cannot afford it, DO NOT get it. how much do i plan on putting a way a month? well that depends. my schedule is like this first week of the month(7th): Car insurance( $189) Second week (18th): Car note ($325.87) third and fourth week (depending what i put a way during the first two weeks) will be half of my pay check.. Gas: my car is a eco friendly vehicle, she gets 389-400miles til empty. and it takes 74 miles to get to my job depending on traffic.. so ultimately i will be filling her up every week(1 1/2 week).. = $45 its all common sense but when you hear it from someone whom is higher and knows what to do, it all comes together. i NEVER want to go thru this again. Your bankruptcy petition, which we prepare for you and file with the Court, begins your bankruptcy case. Whenever you begin a bankruptcy case, the law requires that you provide the Court with a comprehensive picture of your financial condition. The information that we include in the petition we prepare for you includes your income, your expenses, a list of your assets, and a list of your creditors and how much you owe them. As we prepare your petition, we will also discuss with you your finances and provide you advice and counsel. We continue to advise and support you and communicate with you throughout your bankruptcy case. Chapter 7 Las Vegas Before you file bankruptcy you must also take a consumer credit counseling course. Most people choose to take this class online. Part of the chapter 7 bankruptcy process includes the appointment of a bankruptcy trustee. The trustee's job is to make sure that your case is handled properly. One of the trustee's tasks is to review your assets to determine whether any of your assets can be used to pay something to your creditors. In Nevada, most people can generally keep much if not all of their property in a chapter 7 bankruptcy. It is very important that your attorney take the time to discuss with you your assets in order to determine what the law protects (exempt assets) and what the law gives to the trustee (non-exempt assets). Once you file a chapter 7 bankruptcy petition, you will need to attend a meeting of creditors about 30 days later. The trustee runs this meeting, and your creditors are invited to attend. During this meeting the trustee will ask you questions about the information in your petition and make sure you have provided all of the necessary paperwork. How Long Does Chapter 7 Bankruptcy Take?

In a classic Chapter 7 case, where the debtor does not have equity in his assets over the exemption, which is called a no asset case, the typical Chapter 7 case will take about 100 days. You file bankruptcy then within 30 to 40 days, you have a meeting of creditors, although typically creditors never show up and I prefer to call it the meeting with the trustee and that gives the trustee a chance to talk to the debtor about the debtor's bankruptcy schedules that have been filed under oath as part of the bankruptcy case. If we assume that the trustee finds that there are no assets for creditors, he's going to file a no-distribution report right away. Creditors have 60 days after the meeting with the trustee to file objections to the bankruptcy case, which usually only happens in the event of a fraud or an intentional harm or some other specified exception to the discharge laws. If nobody has filed that kind of complaint with the bankruptcy court within that 60 day window, on the 61st day, the bankruptcy court will issue a discharge order and the case will be closed and the court will enter what's called a final decree. The Chapter 7 process is a very short process and that's one of the reasons why it's such a favored remedy for debtors with unmanageable obligations.
