DUI DWI Rights - What happens after a DUI DWI - Field Sobriety Test - DUI ? DUI checkpoint **Do I have to take a breathalyzer, blood test, or urine test if I am stopped for DUI or DWI? You may refuse to take a chemical test (breathalyzer, blood test, or urine test) during a DUI or DWI stop, but almost every state has a so-called "implied consent" law that says a refusal can result in suspension of your driver's license from anywhere between three to 12 months. (This is true even if you're eventually found not guilty of the drunk driving/driving under the influence/driving while intoxicated charge.) Further, if your drunk driving case goes to trial, the prosecutor can tell the jury that you wouldn't take the test, which may lead the jury members to conclude that you refused because you were, in fact, intoxicated or under the influence of drugs. **I was pulled over at a DUI/DWI roadblock and asked to wait and answer a police officer's questions. Is this legal? Yes, as long as the police use a neutral policy when stopping cars (such as stopping all cars or stopping every third car) and they minimize any inconvenience to you and the other drivers. The police can't single out your car at a roadblock unless they have good reason to believe that you've broken the law, such as by driving under the influence of alcohol or drugs (DUI) or driving while intoxicated (DWI). **If I'm stopping for driving under the influence, am I entitled to talk to an attorney before I decide whether to take a breath, blood, or urine test? The answer depends on where you live. In California, for example, you don't have the right to speak with an attorney first before you decide whether to take a breath, blood, or urine test. But some states, including Arizona, allow you to talk to your lawyer before you take a chemical test. **If I'm stopped for driving under the influence (DUI) or driving while intoxicated (DWI), can a police officer ask me questions without reading me my rights? Sometimes. Whether a police officer has to read you your rights on a DUI or DWI stop depends on whether or not you are in police custody -- that is, whether you are subject to the restraints common to a formal arrest. The U.S. Supreme Court has ruled that the police do not have to provide Miranda warnings during roadside questioning of a motorist detained pursuant to a traffic stop. Thus, roadside questioning about your drinking, drug-taking, or performance on field sobriety tests does not constitute "custodial interrogation." In New York, drunk driving is known as Driving While Intoxicated in New York. Other states call such laws Driving Under the Influence or DUI, Operating Under the Influence or OUI and even Operating While Intoxicated or OWI. In New York, these laws are simply known by the acronym DWI. In New York, DWI crimes range from a traffic infraction, misdemeanor and felony, depending on the facts. Driving While Ability Impaired (DWAI), is defined as operating a motor vehicle “while the person’s ability to operate such motor vehicle is impaired by the consumption of alcohol.” Evidence of DWAI may involve cases where a breath or other test results show a BAC of more than .05% and less than .08%. DWAI is not a crime, it is a traffic infraction and does not result in a criminal record. However, unlike many crimes categorized as violations in New York law, DWAI does not deal. DWI as a misdemeanor crime in New York comes in a few forms. The first is what is called DWI by per se intoxication and involves a chemical test result, by breath or blood, of at least .08% BAC. (BAC of .08% is often referred in error as the illegal limit in New York. It is the illegal floor. BAC of .07999999 to infinity is the illegal limit.) Next, DWI by common law intoxication, which is defined as “operate[ing] a motor vehicle while in an intoxicated condition,” is charged when a person refuses to submit to a chemical test so there is no BAC reading. DWAI by Drugs in New York is defined as operating as “operate[ing] a motor vehicle while the person's ability to operate such a motor vehicle is impaired by the use of a drug.” Finally DWAI Drugs and Alcohol is the combined influence of drugs and alcohol. All DWI misdemeanor crimes in New York are punished by up to 1 year in jail, a period of license suspension or revocation, a program to address driving while intoxicated, a monetary fine and an ignition interlock device on all cars owned or operated by the person for a period of time. For people who are arrested for DWI with no prior arrest record, it is possible for a defense attorney to negotiate a non-criminal plea bargain. It depends on the facts and circumstances of each case. Felony DWI in New York is either charged when a person has a prior DWI conviction in any state in the last 10 years or with Leandra’s Law, when a child of 15 or younger is present in a car and person commits DWI. Felony DWI is a class E felony and is punished by 1 1/3 to 4 years in prison and, like misdemeanor DWI, fines, suspension/revocations, a program and ignition interlock devices. However, for the past three decades, the federal government has utilized a carrot-and-stick strategy with federal highway funding as a method of coercing states to enact increasingly harsher “minimum mandatory” DUI penalties. If you don’t pass acceptable DUI laws to suit Uncle Sam, then your state goes without highway funds. Early federal efforts were targeted to creating consistent implied consent laws across America, wherein the DUI offender would suffer license consequences as part of the disposition of the driving while impaired criminal case, such as suspension or revocation, if he or she did not agree to take the official blood, breath or urine test (refusal of breath test) after the DUI arrest. Later, in the 1980s, a civil sanction for mandatory suspension and revocation for either (1) refusal of the state DUI testing after being arrested OR (2) for submitting to breath testing and blowing over the legal limit. This non-criminal sanction created administrative license suspension, administrative license revocation or CDL license disqualification that went into effect before the criminal case ever went to court. In most states, the administrative license actions against your drivers license occur even if you are able to obtain a reduction of charges from the DUI accusation, a dismissal or an acquittal of your DUI criminal case for drunk driving or drugged driving. But that wasn’t all. Two officers spent a few minutes pounding the roof of the car and banging the windows in an attempt to rouse the driver. According to reports, they observed “open containers of silver Coors Light cans in the passenger seat.” It would seem to be an open-and-shut case. Not quite. Upon examining the contents of Monberg’s wallet, one officer says, “Oh, crap.” Looking at one another, without saying a word, both officers pull their body mics out of their pockets — and shut them off. Then they step away from the camera. As it turns out, William Monberg is an investigator for the Columbia Heights Police Department. And Norby and his partner, Officer Brandon Fettig, are performing what is known as “professional courtesy” — the unspoken rule among police that they will not arrest one of their own.
