In today's video, we will be talking about elder law. Elder law takes a general approach to everything I personally practice. There is estate planning, guardianship, conservatorship, and more. All these things are involved with elder law. Sometimes an elderly person will not be able to make decisions for themselves for a variety of different reasons. If this is the case, you might have to go to court and get a guardianship of that person. Guardianship however, is of the person, which means that you decide where they live, etc. While Conservatorship is of the person's money----their financial affairs. Conservatorship is something you will have to get if you want to control the money of the person. Going for a guardianship or conservatorship over a person is a big decision, but if your elderly parent or loved one doesn't have the capacity to make decisions, and have not planned ahead, then guardianship is really the only avenue you can take to protect the rights of your loved one. If you have an elderly parent or loved one that is approaching a situation where they might need a guardianship, you should get them to see an attorney (like myself in Northern Virginia) and get documents drawn up----such as power of attorneys. Doing this will save you from having to go to court to get guardianship and/or conservatorship over them. However, if this does happen to you and you are put into this situation, it's not the end of the world. Another part of elder law is asset protection, which happens if the elderly person has to go into a nursing home. You want to be able to keep as much of the assets that the person has worked hard to earn for their relatives or the well spouse. Asset protection will allow for the elderly person to go into a nursing home under Medicaid.
