What is EXPUNGEMENT? What does EXPUNGEMENT mean? EXPUNGEMENT meaning, - EXPUNGEMENT pronunciation - EXPUNGEMENT definition - EXPUNGEMENT explanation - How to pronounce EXPUNGEMENT? Source: Wikipedia.org article, adapted under https://creativecommons.org/licenses/by-sa/3.0/ license. SUBSCRIBE to our Google Earth flights channel - https://www.youtube.com/channel/UC6UuCPh7GrXznZi0Hz2YQnQ In the common law legal system, an expungement proceeding is a type of lawsuit in which a first time offender of a prior criminal conviction seeks that the records of that earlier process be sealed, making the records unavailable through the state or Federal repositories. If successful, the records are said to be "expunged". Black's Law Dictionary defines "expungement of record" as the "Process by which record of criminal conviction is destroyed or sealed from the state or Federal repository." While expungement deals with an underlying criminal record, it is a civil action in which the subject is the petitioner or plaintiff asking a court to declare that the records be expunged. A very real distinction exists between an expungement and a pardon. When an expungement is granted, the person whose record is expunged may, for most purposes, treat the event as if it never occurred. A pardon (also called "executive clemency") does not "erase" the event; rather, it constitutes forgiveness. In the United States, an expungement can be granted only by a judge; while a pardon can be granted only by the President of the United States for federal offenses, and the state governor, certain other state executive officers, or the State Board of Pardons and Paroles (varies from state to state) for state offenses. Each jurisdiction whose law allows expungement has its own definitions of expungement proceedings. Generally, expungement is the process to "remove from general review" the records pertaining to a case. In many jurisdictions, however, the records may not completely "disappear" and may still be available to law enforcement, to sentencing judges on subsequent offenses, and to corrections facilities to which the individual may be sentenced on subsequent convictions.

Does an expungement erase a criminal record?

01:02
More info at http://www.shouselaw.com/expunge-criminal-records.html Does an expungement in California erase and remove one's criminal record? Not exactly, as this criminal defense attorney explains. Rather, expunging a criminal record simply updates the conviction to show that probation was satisfied and the case was ultimately dismissed. The conviction will still show up on background checks. But once the criminal record is expunged, employers are no longer allowed to use it against you in hiring or promotion decisions.
How does the expungement process work?

02:02
Oftentimes I’m contacted by a client whose criminal case has been completed. Whether that case resulted in a conviction or a dismissal of the criminal charges or a misdemeanor or municipal ordinance or completion of PTI, the question I’m often asked is, “How do I do an expungement?” Here in New Jersey we use expungements to get any history of these convictions or arrests off of our criminal records. If a background check of us is ever conducted, the searching agency does not find a history of arrest or conviction. In New Jersey the way an expungement works is an experienced attorney will fill out a petition as well as other forms that are submitted to the court along with a filing fee. The court forwards that to the prosecutor’s office, it’s looked over, and a hearing date is given approximately a month and a half after filing. In most cases that hearing date is a mere formality where the judge will forward back to the attorney the paperwork signed off with an order indicating to all the agencies involved in your arrest and potential conviction that the history of that arrest and conviction should be expunged from your records. Your attorney would then mail out that order to all those same agencies that existed in the beginning of your case. Sometime later you would receive, or your attorney would receive, a letter from the State Police indicating your record has been expunged. Not everyone who’s been convicted of multiple crimes is eligible for an expungement, but most are. I would suggest that if you believe that your case has been completed and you are or should be eligible for an expungement, that you contact an experienced expungement attorney and discuss the particular facts and circumstances of your case as each is different. If you believe that you are eligible for an expungement, you probably are and a brief phone or in person consultation with an experienced attorney here in New Jersey will determine whether you are correct.

Expungement - Good Cause Hearing

02:27
This training shows an example of a typical expungement for good cause hearing. A disposition of Probation Before Judgment or STET usually require you to wait 3 years before filing for expungement. You may however request the Judge grant the expungement early for "Good Cause". This is a loosely defined term but facts that can be relevant are 1) whether the case is holding the client back from a good job, 2) whether the client is the sole bread winner of their household, and 3) whether they have minor dependents who could be adversely harmed by the criminal record. This video does not constitute legal advice and no attorney-client relationship is formed.

Criminal Records: Do you qualify for expungement?

01:29
In the last video we discussed how employers analyze criminal records. Now it is time for you to decide if you want to pursue expungement. Here are a few facts you should know before you get started. Number one, expungement is not the same thing as sealing. The terms are very close in meaning with subtle differences. However, an expungement means that the criminal record is erased as if they crime never happened. Sealing simply hides the record and make it no longer public information. This is important because each state has different laws that apply to each of these terms. Number two...Each state also varies on what types of charges can be expunged or sealed and who can get their records expunged. It would be nice if expungement was open to everyone...However most violent felonies and serious crimes are not eligible. Records that are usually expunged include: juvenile records, acquittals, dismissals, and some non-violent felonies. And lastly, once your records are expunged you are free to tell employers that you have never been arrested or charged of a crime. This is obviously the greatest benefit of expungement. If you are interested in expunging or sealing your records, you need to pull your rap sheet and find out the specifics of your charges. This can be done manually by contacting every court system in the counties you were arrested. However, you will save time and money and get accurate results by using a company like Integrasan.com to pull the records for you. Simply log onto the website, enter your information and access your records.

Clear Criminal Record - Expungement | Michigan Attorney Kevin Bessant (313) 658-8159

00:46
Criminal Record Expungement - Michigan Lawyer Kevin Bessant understands the difficulties and challenges having a criminal conviction can have on your life. Clear your record now: https://KevinBessantLaw.com/expungement-michigan A criminal conviction can lead to a loss of employment; housing; government help; financial aid; professional licensing and many other opportunities that are often gone after a background check reveals a felony or misdemeanor conviction on your record. But the State of Michigan allows for an individual who has been convicted of felony or misdemeanor conviction(s) to ask for a set-aside of the criminal conviction so that it is removed from public access. This way it will no longer show up in background check or criminal record search. You need to understand the many laws that govern record sealing in Michigan to make sure that you qualify to have your criminal conviction set-aside and removed from your record. In Michigan record removal (legally known as Expungements) are governed by State Law under MCL 780.621. Until 2015 a person founded guilty of a felony and a misdemeanor, or multiple misdemeanor criminal offenses were blocked from seeking a record removal. However in 2015, Michigan amended the law to permit those who satisfy the following requirements to seek a criminal expungement: • Must be convicted of not more than 1 (one) felony offense, and no more than two misdemeanor offenses to apply for a criminal expungement. • If you have never been convicted of a felony offense, but have no more than 2 misdemeanor offenses on your criminal record, you are eligible to seek the deletion of both criminal misdemeanors. • If convicted of Criminal Sexual Conduct in the 4th (fourth) Degree, and this conviction occurred prior to January 12, 2015, you can petition the court for a criminal expungement so long as the CSC 4th conviction occurred prior to your 21st birthday and you have no more than two (2) minor offenses on your record (a minor offense is an offense where the maximum penalty is 90 days in jail and or $1000.00 fine). • If previously convicted of a felony or misdemeanor offense, and that felony or misdemeanor was taken under a deferred status and dismissed such as Michigan’s HTYA (Holmes Youthful Training Act) law, Delayed Sentence 771.1, or first time drug offender status under 7411, that dismissal will count as a misdemeanor conviction for expungement purposes. • A felony in which the maximum sentence is life imprisonment (capital ffenses such as murder, armed robbery, car jacking, etc.) are not allowed to be expunged. • Any conviction under Michigan’s child abuse 1st-4th degree statues cannot be expunged. • Traffic offenses taken under Michigan’s Motor Vehicle Code cannot be expunged. These do not include civil infractions, but rather traffic felony and misdemeanor offenses such Operating While Intoxicated (OWI)/drunk driving; no insurance; driving while license suspended or revoked; open alcohol in vehicle, etc. • A felony conviction for Domestic Violence cannot be expunged if the person also has a previous misdemeanor conviction for Domestic Violence. • You must wait 5 years from the date of your discharge from probation or release from prison and not 5 years from the date of the conviction before you can apply for an expungement. Assuming someone meets all the above requirements, they may now petition the sentencing court to set-aside their criminal conviction. Seeking the support of a legal representative well trained in the nuances of Michigan Expungement laws is vital to ensure your success in expunging your criminal history. After a careful review of your application products and supporting documents, Michigan Expungement Attorney Kevin Bessant likewise makes the necessary preparations for the actual hearing prior to the judge to persuade the court of the necessity to expunge your rap sheet. WARNING: if your expungement process is not handled correctly and your request is denied by the Judge, Michigan's law forces you to wait three years before you can re-apply. #ExpungementMichigan #clearcriminalrecord #expungecriminalrecord #criminalrecordexpungement #expungerecords #cleancriminalrecord #sealcriminalrecord #erasecriminalrecord #removecriminalrecord #criminalrecordremoval #criminalrecorderased

Illinois Expungement Explained: How to Expunge Your Criminal Record in Illinois

03:50
In this episode of Learn About Law we explain the process of #sealing and #expunging criminal records in the state of Illinois. Expungement is the process of having your criminal records physically destroyed or returned to you and of removing the record from public view. On the other hand, if your records are sealed, they are not physically destroyed. However, sealed records are not obtainable without a court order and are removed from public view. Niether expunged or sealed records are visible in criminal checks. Employers may not consider expunged or sealed records in determining employment and may not ask an applicant if he or she has had records expunged or sealed. Subscribe: https://www.youtube.com/channel/UCY4QhGg-zwgUIthoK3EdyjA?sub_confirmation=1 More Learn About Law videos, podcasts, and articles: http://www.learn-about-law.com Schedule a Free Consultation or Learn More about O'Flaherty Law: http://www.oflaherty-law.com Please call us today at (630)324-6666 to schedule a free consultation. New NJ expungement law 2018

02:20
Updated Expungement Law changes procedures for expunging criminal records signed in 2017 taking effective October 1, 2018 • Allowing a petitioner to expunge up to four, instead of three, offenses or multiple offenses that occurred within a short timeframe, if the petitioner has not been convicted of any prior or subsequent offense; • Reducing the expungement eligibility waiting period from 10 years to six years, following the latest of any conviction, payment of fine and completion of probation, parole or prison sentence; • Further reducing the expungement eligibility waiting period if satisfaction of a fine or restitution is the petitioner’s only remaining barrier and the court finds that the expungement is in the public’s interest; and • Aligning expungement and sentencing statutes, allowing expungement for possession of marijuana with the intent to sell up to one ounce, which is the threshold for a fourth-degree crime. The new law decreases from five to three years the waiting period to expunge an entire juvenile record, maintaining all other requirements and provisions.

Or they simply need this done so that they can get a decent paying job. We'll let the court know something personal about you when we prepare this petition and in our affidavit that we have you signed, we'll also have you swear under oath about why you need this done, which we think is powerful evidence when filing this petition with the court. If you're doing it on your own, you will need to take the petition, the certificate, the affidavit and order, and make sure to make a photocopy of all of that. Write a letter to the judge with a copy of all four aforementioned items and send it to the judge's judicial assistant. Make sure that you get the correct judge and correct judicial assistant and address because if you send it to the wrong judge, you may get returned, creating another delay in the process. Several factors impact the length of time an expungement takes to go through the court system. Some of these factors are: the length of time between the conviction and the filing of the expungement; whether or not the case is in the current computer system at the courthouse where the expungement needs to be filed; whether or not the case is a felony or misdemeanor; how complex the case is; whether or not the case file is in storage off-site from the courthouse where the expungement needs to be processed; and if the Court wants a Probation Report prepared prior to the Court hearing. 800 495 2819 || http://www.record-clear.com/

Am I Eligible for Expungement of My Pennsylvania Criminal Record

02:51
I receive multiple calls a day from people asking whether they can receive an expugement of their criminal record. I can generally answer their question with a clear yes or no after asking them a few questions about their past case(s) and with a few clicks on my keyboard. In Pennsylvania, you are only eligible for expungement of your criminal record if your case was dismissed by the court, withdrawn by the District Attorney or you were found not guilty following a judge or jury trial. If you were convicted, found guilty or pled guilty, you are not eligible for expungement of your criminal record. The only current exception to this rule is if you were convicted or pled guilty to a summary. And, even then, you must wait five years from the date of conviction and have no further contact with the system to obtain expungement. In this video, I will discuss in more detail when you are eligible for expungement of your criminal record and a bit about the process. Additionally, there are links below to two articles I've written on the subject. One lays out the process in even greater detail while the other discusses a pending bill that would allow expungement of certain low-level misdemeanors after either 7 or 10 years. But, this is not currently the law. The only way to have a misdemeanor or felony conviction removed from your record now is through a pardon from the governor.
