A very real distinction exists between an expungement and a pardon. Oftentimes I’m contacted by a client whose criminal case has been completed. Whether that case resulted in a conviction or a dismissal of the criminal charges or a misdemeanor or municipal ordinance or completion of PTI, the question I’m often asked is, “How do I do an expungement?” Here in New Jersey we use expungements to get any history of these convictions or arrests off of our criminal records. If a background check of us is ever conducted, the searching agency does not find a history of arrest or conviction. In New Jersey the way an expungement works is an experienced attorney will fill out a petition as well as other forms that are submitted to the court along with a filing fee. The court forwards that to the prosecutor’s office, it’s looked over, and a hearing date is given approximately a month and a half after filing. In most cases that hearing date is a mere formality where the judge will forward back to the attorney the paperwork signed off with an order indicating to all the agencies involved in your arrest and potential conviction that the history of that arrest and conviction should be expunged from your records. Your attorney would then mail out that order to all those same agencies that existed in the beginning of your case. Sometime later you would receive, or your attorney would receive, a letter from the State Police indicating your record has been expunged. Not everyone who’s been convicted of multiple crimes is eligible for an expungement, but most are. I would suggest that if you believe that your case has been completed and you are or should be eligible for an expungement, that you contact an experienced expungement attorney and discuss the particular facts and circumstances of your case as each is different. If you believe that you are eligible for an expungement, you probably are and a brief phone or in person consultation with an experienced attorney here in New Jersey will determine whether you are correct.

Number one, expungement is not the same thing as sealing. The terms are very close in meaning with subtle differences. In Michigan record removal (legally known as Expungements) are governed by State Law under MCL 780.621. Until 2015 a person founded guilty of a felony and a misdemeanor, or multiple misdemeanor criminal offenses were blocked from seeking a record removal. However in 2015, Michigan amended the law to permit those who satisfy the following requirements to seek a criminal expungement: • Must be convicted of not more than 1 (one) felony offense, and no more than two misdemeanor offenses to apply for a criminal expungement. • If you have never been convicted of a felony offense, but have no more than 2 misdemeanor offenses on your criminal record, you are eligible to seek the deletion of both criminal misdemeanors. • If convicted of Criminal Sexual Conduct in the 4th (fourth) Degree, and this conviction occurred prior to January 12, 2015, you can petition the court for a criminal expungement so long as the CSC 4th conviction occurred prior to your 21st birthday and you have no more than two (2) minor offenses on your record (a minor offense is an offense where the maximum penalty is 90 days in jail and or $1000.00 fine). • If previously convicted of a felony or misdemeanor offense, and that felony or misdemeanor was taken under a deferred status and dismissed such as Michigan’s HTYA (Holmes Youthful Training Act) law, Delayed Sentence 771.1, or first time drug offender status under 7411, that dismissal will count as a misdemeanor conviction for expungement purposes. • A felony in which the maximum sentence is life imprisonment (capital ffenses such as murder, armed robbery, car jacking, etc.) are not allowed to be expunged. • Any conviction under Michigan’s child abuse 1st-4th degree statues cannot be expunged. • Traffic offenses taken under Michigan’s Motor Vehicle Code cannot be expunged. These do not include civil infractions, but rather traffic felony and misdemeanor offenses such Operating While Intoxicated (OWI)/drunk driving; no insurance; driving while license suspended or revoked; open alcohol in vehicle, etc. • A felony conviction for Domestic Violence cannot be expunged if the person also has a previous misdemeanor conviction for Domestic Violence. • You must wait 5 years from the date of your discharge from probation or release from prison and not 5 years from the date of the conviction before you can apply for an expungement. Assuming someone meets all the above requirements, they may now petition the sentencing court to set-aside their criminal conviction. Updated Expungement Law changes procedures for expunging criminal records signed in 2017 taking effective October 1, 2018 • Allowing a petitioner to expunge up to four, instead of three, offenses or multiple offenses that occurred within a short timeframe, if the petitioner has not been convicted of any prior or subsequent offense; • Reducing the expungement eligibility waiting period from 10 years to six years, following the latest of any conviction, payment of fine and completion of probation, parole or prison sentence; • Further reducing the expungement eligibility waiting period if satisfaction of a fine or restitution is the petitioner’s only remaining barrier and the court finds that the expungement is in the public’s interest; and • Aligning expungement and sentencing statutes, allowing expungement for possession of marijuana with the intent to sell up to one ounce, which is the threshold for a fourth-degree crime. The new law decreases from five to three years the waiting period to expunge an entire juvenile record, maintaining all other requirements and provisions.

I receive multiple calls a day from people asking whether they can receive an expugement of their criminal record. I can generally answer their question with a clear yes or no after asking them a few questions about their past case(s) and with a few clicks on my keyboard. In Pennsylvania, you are only eligible for expungement of your criminal record if your case was dismissed by the court, withdrawn by the District Attorney or you were found not guilty following a judge or jury trial. If you were convicted, found guilty or pled guilty, you are not eligible for expungement of your criminal record. The only current exception to this rule is if you were convicted or pled guilty to a summary. And, even then, you must wait five years from the date of conviction and have no further contact with the system to obtain expungement. In this video, I will discuss in more detail when you are eligible for expungement of your criminal record and a bit about the process. Additionally, there are links below to two articles I've written on the subject. One lays out the process in even greater detail while the other discusses a pending bill that would allow expungement of certain low-level misdemeanors after either 7 or 10 years.
