Bisogna tener presente quindi che ci sono dei rischi specifici del contratto di franchising: 1) L'affiliato è meno autonomo di altri imprenditori, risultando così un imprenditore dimezzato, limitato nella libertà di azione a causa della clausole inserite nel contratto di franchising. In alcuni casi queste clausole sono funzionali al franchising preservando l'uniformità della rete, l'immagine commerciale della rete ed il know how, ma in altri casi sono clausole troppo restrittive che non rientrano nella fisiologia del franchising e che limitano eccessivamente l'operato dell'affiliato. 2) C'è una debolezza contrattuale del franchisee, dovuta alle sue scarse conoscenze nel settore che offre al franchisor la possibilità di imporre il proprio modulo contrattuale, spesso sbilanciato, e di offrire, prima della sottoscrizione del contratto, informazioni insufficienti o anche non corrette. Quindi, a meno che il franchisee non abbia particolari competenze nel campo, sarebbe utile rivolgersi a specialisti nel settore, dal momento che la legge 129/2004, è stata emanata per imporre una serie di obblighi informativi precontrattuali, ma non è sufficiente a tutelare il franchisee perché regolamenta solo la fase precedente alla sottoscrizione del contratto e le informazioni previste come obbligatorie non danno un quadro ampio della situazione (ad esempio non c'è l'obbligo di dare informazioni sull'approvvigionamento dei beni, né di offrire una situazione del mercato nel quale si andrà ad operare). Un legale specializzato nel franchising, come LegaleFranchisee, permette di scongiurare pericoli o di minimizzare conseguenze negative e al quale è consigliabile rivolgersi ancora prima della sottoscrizione del contratto per ottenere le informazioni che i franchisor non sono obbligati a dare per legge e per ottenere un contratto finale valido, equilibrato e tutelante, che permetta di prevenire contenziosi futuri. When we get calls from millennials they never ask about Subway, 7-11, Gas Stations or Quiznos! Not once. And I attribute that to the fact millennials are much better at researching online and have already discovered why they don't want to own any of those. They quickly compare the data on those franchises, aren't happy and they want more. Millennials ask more about emerging franchises, about unique franchises. They are much more open to exploring things outside the box. Which is great for them because there are so many really lucrative and fun franchises to open. Conversely almost half the calls we get from people in their 40's and up are asking about Subway, 7-11 and Gas Stations, which would be fine if anyone knew why they wanted to own one! But when I ask people why they want to own these franchises I have yet to hear a good answer. They don't know the earnings, the failure rates, the franchisee satisfaction rates and they don't do any comparative research. I've done videos on that before on how a 7-11 owner has a franchise right across the street literally making 10 times more than he is and he had no idea because he didnt do research or speak to anyone else. Millennials are great at research and even before they call us they usually have enough data that we can get right into a high level conversation regarding the pros and cons of franchises. Which takes us to our first Millennial story Dylan Patel. Dylan started his franchise empire as a freshman still in college. He didnt want a Subway - in fact he did a ton of research and ended up opening up a fitness franchise - Orangetheory fitness. Now Orangetheory is a fairly expensive franchise investment costing about $500-$900K but Dylan took out some loans and his family helped him get started. Just as a side note we work with fitness franchises that can be started for under $100K give us a call if you would like to learn more. (sorry I cant help myself) Now despite Dylan still being in college he has opened two more Orangetheory locations and also opened a Hand and Stone Massage and facial Spa franchise as you can see here in the picture. We work with Hand and Stone and do like the business model. Dylan has just opened and has 100 clients already in his first two weeks. Now this is how you build a business empire. Could Dylan have done this with a 7-11 store? No because he would have had to be working in one store as a requirement of the franchise. These newer franchises allow the flexibility and operational model for an owner to be semi absentee and the business still operates effectively. There is also sufficient revenue that you can pay managers to run the business so Dylan just oversees the franchises between classes and after school. Great example of making strong, educated decisions in franchising and we wish Dylan continued success. Another couple of millennial who have entered the franchising world are Andrea and Jessica Perez, two sisters from San Antonio who with the help of family bought a struggling Wing Zone and have already turned the business around and are grossing $170,000 a month. Now just for the record Wing Zone franchise is not one of our top choices but if they got a bargain and work the business properly as it appears they are doing they will likely continue to see success. So there you have it - just two stories of how Millenials are breaking into the world of franchising. An interesting statistic before we go - according to FRANdata 9% of all franchise owners are actually Millennial and that number is sure to climb as us old folks begin to retire.
