For the second podcast, I prepared a thirteen step overview of settling an estate in case you ever get asked to be someone’s executor of estate (or, if your prefer the modern term, personal representative). The probate process is a creature of state law that is mostly governed by each state’s statute, so it’s not an exaggeration to say that every state is different--the steps of administering an estate in California will have way different requirements than Texas. Still, there are general steps that are generally followed in all states, and I provided a twenty minute overview of what the process entails if you’re interested in getting the lay of the land for administering someone’s estate. #1. Funeral Arrangements #2. Find the will, identify assets, protect against theft and conversion, tally expenses #3. Determine probate assets vs. non probate assets #4. Petition to probate court, usually to admit the will into probate (standard form documents)...if no will, petition for administration and appointment of representative #5 The Will must be “proved” #6 The court will sign an order admitting the will to probate and issue a Letters Tesamentary to the executor--this is a grant of authority to pay bills and distribute the assets #7. Most wills waive the bond, so no need to guarantee performance #8. Formal or Informal: If formal, court supervision. If informal, inform at completion. Universal succession--automatic title grant, obligation to pay creditors. #9. Formal: Assets are put on inventory sheet for the court--appraisal may be required. #10. Collect all assets, and call up and use Letters Testamentary if necessary. Establish a new bank account: “Executor for the estate of ____________” transfer all property to this account. Sell the car, write the check for “Estate of ___________” ….pay debts, attorney fees, and other expenses. #11. “Holding period” --assets get assembled, creditors get to file claims. Is it valid or not? If valid, pay it up. Otherwise, tell them to go to the judge. #12. During holding period, gauge tax liability. Estate, inheritance, and death taxes. If yes, file returns and pay taxes. Gotta sell the car to pay the tax bill? Do it. If family allowance request, take it to the judge. #13. "Probate a simple guide" First step you need to take it to find out if the deceased made a will and usually the first port of call is the deceased's solicitors but look through their personal papers, banks, and there are other avenues open if you can't find a will. "What if there is no will?" If there is no will then the deceased estate is governed by what is known as the laws of intestacy, and the laws of intestacy determine who takes out the grant, usually the deceased's next of kin and they become administrators and they have the same functions as executors under a will and both are called personal representatives. "What needs to be done next?" The first thing that needs to be done is to register the death with the local registry of births, deaths, and marriages and then you'll need to make funeral arrangements, the will sometimes contains directions as to what is to happen, but if not the family may know what the deceased's wishes were. "Who identifies assets and debts?" The personal representatives are responsible for ascertaining the assets and liabilities of the estate. "How do they do that?" They have to go through the deceased's personal papers and it is a fairly onerous task because HMRC impose penalties if they feel a person's representative hasn't applied due diligence and made a thorough investigation. "What is a grant of probate?" A grant of probate, or a grant of letters of administration is the title or right of the personal representative to deal with the deceased's assets. "Is a grant of probate always needed?" Not always, there are cases where, if a property is owned jointly the share of the deceased may automatically pass to the survivor. There are also cases where estates are very small and the bank or building society where the deceased had savings will accept a declaration made by the personal representative rather than going for a full round of probate. I’m John Williams, Certified Financial Planner and Senior Advisor at Ironwood Wealth Management and today I want to go over how assets pass on after you pass away. The law provides each of us with the right to own property since we are alive. However, if you’re not alive, you don’t have property rights. After you pass away, your property has to transfer to someone else or an entity. So who has the authority to decide who is entitled to our property and to transfer it? Let’s look at how assets transfer after you pass away. Typically there are two ways assets pass at death – through a court and out of a court. Some assets, by their very nature, are out-of-court assets. For example, when someone is designated as the beneficiary of life insurance, that beneficiary collects the money upon the death of the policyholder without it going through a court. The insurance company simply pays whoever your beneficiary is. I want to mention, you can change an in-court transfer to an out-of-court transfer by how an asset is titled. A good example is when you set up the title to real estate as joint tenants with rights of survivorship. At the death of the first owner, the surviving owner receives the entire real estate interest without going through the court. Assets that transfer through the court after death are also known as probate assets. Very simply, probate is just the court process of deciding what goes where. If you die with a valid will it is known as testate, and your will generally guides the probate process. On the other hand, if you die without a valid will that is called intestate. When that happens, the court will use the law and its judgment to decide who gets what. In general, if an asset isn’t the out-of-court type, it must pass through the probate process. Out-of-court assets or nonprobate assets are just as they sound. They are assets that pass outside the court system. Many times, out-of-court transfers occur by a contract of some kind like life insurance, IRAs, retirement plans, annuities, and assets held jointly with rights of survivorship. Your beneficiaries will receive those out-of-court assets directly. Suppose I listed my son, as my beneficiary on my IRA, but I listed my daughter as the beneficiary in my will. Who do you think gets the money in the IRA? The answer is my son. With assets that pass via contract, whoever is listed as beneficiary, will receive the assets regardless of the will. Another type of out-of-court asset are those held by irrevocable trusts. These assets do not go through probate, because, you don’t own them – the trust does. When you die, only the assets you own directly are included in your probate estate. Since assets in an irrevocable trust don’t technically belong to you, they are not included your probate. After your death, the trust merely follows your instructions about who gets what and when. So if it makes sense, you can put some or all of your assets in a trust before you die, which turns assets that would’ve passed through the court system into out-of-court assets. The death is usually registered by the closest relative. 2. You should then start making the funeral arrangements and also find out if your relative made a will and who was appointed as executors. The will may sometimes contain directions for the funeral. There should be a copy of the will at home and the original will usually be held by the solicitor or wills draftsman or by the bank. What is the role of the executor? The executor's role is to administrator the estate i.e. (i) to obtain probate - if that is necessary (ii) close off bank accounts and investments (iii) pay off debts and inheritance tax (iv) distribute or dispose of personal effects (v) sell or transfer any property (vi) paying legacies (vii) distributing the estate amongst the beneficiaries Who can be an executor? Executors can be family or friends, or a firm of solicitors. Family or friends who are named as executors can also employ a firm of solicitors to administer the estate for them. What is probate? Probate is basically proving the validity of the will through the probate registry - which is a branch of the courts. To apply for probate you will need to supply details of all the assets and liabilities in the estate - in the application forms. Why is probate needed? Probate is needed to release the assets of the deceased to the executors. Each organisation (bank, building society etc) has a different limit above which probate is needed. Usually this is around £20,000. Joint assets generally pass to the surviving joint owner and probate is not needed or these. What happens if there is no will? If there is no will, then the relative will have died intestate. This can delay and complicate matters so you should contact a solicitor as soon as possible. The law sets out the order in which family take the estate and also who can take out the grant to administer the estate. When is inheritance tax payable? There is no inheritance tax payable between spouses or civil partners. Otherwise it is paid on estates worth over £325,000 or if there is transferable nil rate band from a spouse or a civil partner who has died first, then the nil rate band can be as much as £650,000. There are other reliefs and exemptions available about which your solicitor can advise. Otherwise inheritance is payable on all assets over the available nil rate band payable at 40%. Probate is the legal process whereby a will is "proved" in a court and accepted as a valid public document that is the true last testament of the deceased. The granting of probate is the first step in the legal process of administering the estate of a deceased person, resolving all claims and distributing the deceased person's property under a will. A probate court decides the legal validity of a testator's (person's) will and grants its approval, also known as granting probate, to the executor. The probated will then becomes a legal instrument that may be enforced by the executor in the law courts if necessary. A probate also officially appoints the executor (or personal representative), generally named in the will, as having legal power to dispose of the testator's assets in the manner specified in the testator's will. However, through the probate process, a will may be contested. The English noun "probate" derives directly from the Latin verb probare, to try, test, prove, examine, more specifically from the verb's past participle nominative neuter probatum, "having been proved". Historically during many centuries a paragraph in Latin of standard format was written by scribes of the particular probate court below the transcription of the will, commencing with the words (for example): Probatum Londini fuit huismodi testamentum coram venerabili viro (name of approver) legum doctore curiae prerogativae Cantuariensis... ("A testament of such a kind was proved at London in the presence of the venerable man ..... doctor of law at the Prerogative Court of Canterbury...") The earliest usage of the English word was in 1463, defined as "the official proving of a will". The term "probative," used in the law of evidence, comes from the same Latin root but has a different English usage.
