A day after President Trump’s executive order caused entry problems for U-S visa holders from several Middle Eastern nations, restrictions are also extended to those who hold Green Cards. According to the Homeland Security Department, the action also includes foreign nationals from those countries who have legal permanent U-S residency. The measure took its first tolls Saturday when five Iraqi passengers and one Yemeni national, who all had U-S entry visa, were barred from boarding an EgyptAir plane flying from Cairo to New York. Donald Trump on Friday signed an order, barring all citizens and refugees from Iraq, Syria, Iran, Sudan, Libya, Somalia and Yemen from entering the United States for three months. He says the halt is necessary to give agencies time to map out a stricter screening system. http://www.cheryldavidlaw.com/ People often come to my office and wonder if they will get deported from an arrest or crime conviction, which is generally a normal concern and I would be scared too. Whether or not you’re going to be deported on a criminal conviction is going to, obviously, depend on the conviction. Immigration has a broad range of crimes that make you removable from the United States. Even if it’s a misdemeanor under criminal law, that doesn’t mean it’s a minor offence for immigration law. Generally, drug offences are going to always make you removable from the United States, except in the case of a small amount of marijuana if you are in the United States. Anything else, such as a theft offence, a fraud offence, or a violent felony can make you removable from the United States. Please don’t take for granted that you have a conviction that was considered to be a minor offence under criminal law or you got a conditional discharge, it was dismissed in one year, that that’s no longer a conviction. That’s not necessarily true for immigration purposes. You want to discuss the crime with an immigration lawyer. You want to make sure that if you apply for citizenship or you travel it’s not going to catch up with you in the future. Just because a criminal lawyer says something was dismissed, may not be true for immigration law just because under criminal law it wasn’t a big penalty. If you didn’t go to jail and only did probation, that does not mean it’s not serious for immigration law. It’s very important to understand the criminal conviction and bring that to an immigration lawyer with all of your documentation to discuss it thoroughly and make sure you understand the consequences of that criminal conviction. Most importantly, if you’re dealing with a criminal case currently and it’s pending, it’s very important that your criminal lawyer tells you the immigration consequences or you speak with an immigration lawyer. In fact, it’s required under criminal law now that a criminal lawyer makes certain that you understand the immigration consequences, otherwise, that plea could be vacated in the future as not a valid plea. If you’re in the situation where you have a pending criminal case, it’s very important to discuss your situation with an immigration lawyer and if you’d like to discuss your situation with me, we’d be happy to meet with you and your criminal lawyer to discuss and good luck.

How to Bringing a Spouse of a Lawful Permanent Resident to Live in the US as Resident

Eligibility to bring your spouse to live in the U.S. as a lawful Permanent Resident (Green Card holder) In order to bring your spouse (husband or wife) to live in the United States as a permanent resident (green card holder), you must be either a U.S. citizen or permanent resident. Spouse of a Permanent Resident Inside The United States - Possible Adjustment of Status The spouse of a Lawful Permanent Resident can qualify for "adjustment of Status " while in the United States as an "2nd Preference" immigrant. This can be done only if the spouse (1) entered with a visa and is still legally in the United States or (2) if they entered illegally or is out of status but an application for immigrant status with the USCIS was filed before 4/30/01 or with the department of labor for Labor Certification before 4/30/01 or they were derivative beneficiary of a parents petition. All other spouse of Lawful Permanent residents that either entered illegally in the United or is out of status will have to apply for a waiver of the 3/10-year bar. The adjustment of Status application is filed with the local USCIS office having jurisdiction over the Petitioner's residence. The packet is generally filed with an application for Employment Authorization and if desired with a permission to travel during the process (Advance Parole) (if they have not been out of status for a period of over 6 months on the date of filing.) A few months later a notice is sent directing the applicant to (1) appear for processing of the employment authorization (EAD) (2) take fingerprints (3) appear for the adjustment interview. On the date of the adjustment interview you should be granted a permanent Immigrant Visa (Green Card). The spouse may file for U.S. citizenship 5 years after the approval of the Permanent Visa (Green Card). Spouse Of A Permanent Legal Resident Living Outside The United States (visa processing) The first step in establishing your eligibility to immigrate to the United States is to have your Lawful Permanent Resident spouse file an Immigrant Visa Petition with the office of the U.S. Immigration & Citizenship Service (USCIS) having jurisdiction over his/her place of residence. Petitions Required to be Filed in the U.S. -- File the I-130 petitions at the USCIS Service Center having jurisdiction over their place of U.S. residence. Filing Petitions Abroad - Petitions, Form I-130, which can be filed abroad, are limited. Petitions for immediate relative immigrant or 1st preference petition classifications can be filed abroad by Lawful Permanent Resident petitioners who have been authorized to be continuously resident in their consular districts for at least the preceding six months, including members of the U.S. armed forces, emergency cases involving life and death or health and safety, and others determined to be in the national interest. Petitions are filed with USCIS abroad or at the U.S. Embassy or Consulate (when there is no USCIS presence). If the petitioner presently resides abroad, s/he can file petition by post to the USCIS office at the Embassy. Proof of residence in the country is required If the petition is approved, the petition will be forwarded to the National Visa Center and will eventually send the approved petition to the Immigrant Visa Branch at this Embassy for further processing of the visa. If your Lawful Permanent resident spouse resides in the U.S. s/he should file with the USCIS office having jurisdiction over his/her place of residence in the United States. The processing can take several months. USCIS will send the approved petition to the National Visa Center (NVC) for further processing NVC plays an important role in the U.S. immigration process. NVC provides instructions to petitioners and sponsors, and receives from sponsors, the required Affidavit of Support forms, fees, other required documents, and much more. For numerically limited family preference petitions, NVC contacts the petitioner once the petition's immigration wait nears end, and the priority date is about to come current. Once the priority date is current the NVC will send you a package to prepare. This package contains all the vital information needed to approve the Permanent Visa (Green Card). You will send the completed package to the U.S. consulate were the parent resides The U.S. Consulate will notify you of the interview date and the address for the medical exam and fingerprints once the priority date become current. Accompanying Children All unmarried children under the age of 21 can be included in the petition. If they are over twenty on the CSPA (Child Status Protection Act) may be able to give them additional after the age of 21.

http://www.cheryldavidlaw.com/ It’s important to remember that once you have your green card you can’t stay out of the United States for too long of a period, otherwise, you run the risk of abandoning it. The rule of thumb, generally, is that you don’t want to stay out of the United States for more than six months at a time because then you are interrupting your continuous presence in this country. You will get into trouble if you stay out of the United States for more than one year at a time because legally, you’ve abandoned your residence. It generally won’t come up unless you’re traveling in and out of the United States or stay outside of the United States for long periods of time. If at the border, immigration thinks that you’re spending more time outside of the United States, presumably if you’ve stayed out for more than a year, then you do run the risk of them trying to take the green card away from you at the airport. They will ask you to either abandon the card or place you into removal proceedings if you’d like to fight for the card. In my experience, I don’t generally see repeat customs border patrol do that if you’ve done it on one occasion. I don’t recommend, as a practice, to go living overseas once you get your green card. If you think you’re in the situation where you might want to stay out of the United States for a lengthy period of time, at least a year or more, then it’s important to apply for a re-entry permit. That allows you to stay outside of the United States for more than two years at a time without losing your status. If you have questions about living overseas and you are a green card holder, it’s important to discuss your situation with an immigration lawyer so you don’t abandon your residence and I’d be happy to discuss your situation with you.

Spouse of A U.S. Citizen Inside The United States - Adjustment of Status The spouse of a United States citizen can qualify for "adjustment of Status " while in the United States as an "immediate relative" immigrant. This can be done only if the spouse (1) entered with a visa or visa waiver program or (2) if they entered illegally or are out of status an application for immigrant status with the USCIS was filed before 4/30/01 or with the department of labor for Labor Certification before 4/30/01 or they were derivative beneficiary of a parents petition. All other spouse of U.S. Citizens that either entered illegally in the United may have to apply for a waiver of the 3/10-year bar. The adjustment of Status application is filed with the local USCIS office having jurisdiction over the Petitioner's residence. The packet is generally filed with an application for Employment Authorization and if desired with a permission to travel during the process (Advance Parole), if they have not been out of status for a period of over 6 months on the date of filing. A few months later a notice is sent directing the applicant to (1) appear for processing of the employment authorization (EAD) (2) take fingerprints (3) appear for the adjustment interview. Spouse of A U.S. Citizen Living Outside The United States The first step in establishing your eligibility to immigrate to the United States is to have your U.S. citizen spouse file an Immigrant Visa Petition with the office of the U.S. Citizenship and Immigration Service (USCIS) having jurisdiction over his/her place of residence. Petitions Required to be Filed in the U.S. -- File the I-130 petitions at the USCIS Service Center having jurisdiction over their place of U.S. residence. Filing Petitions Abroad - Petitions, Form I-130, which can be filed abroad, are limited. Petitions for immediate relative immigrant or 1st preference petition classifications can be filed abroad by American citizen petitioners who have been authorized to be continuously resident in their consular districts for at least the preceding six months, including members of the U.S. armed forces, emergency cases involving life and death or health and safety, and others determined to be in the national interest. Petitions are filed with USCIS abroad or at the U.S. Embassy or Consulate (when there is no USCIS presence). If the U.S. citizen parent (the petitioner) presently resides abroad, s/he can file petition by post to the USCIS office at the Embassy. Proof of residence in the country is required If the petition is approved, the petition will be forwarded to the National Visa Center and will eventually send the approved petition to the Immigrant Visa Branch at this Embassy for further processing of the visa. If your U.S. citizen spouse resides in the U.S. s/he should file with the USCIS office having jurisdiction over his/her place of residence in the United States. The processing can take several months. USCIS will send the approved petition to the National Visa Center (NVC) for further processing NVC plays an important role in the U.S. immigration process. NVC provides instructions to petitioners and sponsors, and receives from sponsors, the required Affidavit of Support forms, fees, other required documents, and much more. For numerically limited family preference petitions, NVC contacts the petitioner once the petition's immigration wait nears end, and the priority date is about to come current. The NVC will send you a package to prepare. This package contains all the vital information needed to approve the Permanent Visa (Green Card). You will send the completed package to the U.S. consulate were the parent resides. The U.S. Consulate will notify you of the interview date and the address for the medical exam and fingerprints once the priority date become current.
