Do immigrants need to register for Selective Service and what if they don’t?

04:05
Our Website: https://hackinglawpractice.com/ My Podcast: https://immigrationanswershow.com/ Do immigrants have to register for selective service? I am Jim Hacking immigration attorney practicing law here at St. Louis Missouri. Everyone knows that US citizen males between the ages of 18 and 26 have to file with the selective service. Selective service is the draft that is that young man between the ages of 18 and 26 have to register for the draft and make themselves available to the US Army and Arm Forces in case of National emergency. Now of course we haven't have a draft since the 70's and I think there be a lot of political pressure against ever re-instituting the draft. The fact is that there are people who are required to register for selected service. Like I said obviously citizens have to, males between the ages of 18 and 26 or US citizens do. How about immigrants? Do people here on student visas, or asylum, or green cards. Do they have to apply with selected service as well? Now mostly with selected service itself is generally pretty straight forward. All you have to do is go online and fill up the form a lot of places let you do it at the Department of motor Vehicles. Registration itself is not that [authorize 00:01:16]. Like I said there hasn't been a draft in a long time. There's really no reason to not register with selective service. Where this comes up is when you apply for citizenship. Because they want to make sure if you were required to apply for selective service that you did in fact do so. All right, the easy way to keep it in mind is that if people are staying in the United States as an immigrants, they have to register with Selective Service. Young man between the ages of 18 to 26 who have their green card, or who came as refugees or who came and obtained asylum in the United States. All those young men have to apply for selective service and register with selective service. Then at the same time students, or visitors do not have to register for selective service. It's actually a pretty simple way to keep it in mind is if you're residing permanently in the United States, either as an asylum seeker, or refugee or green card holder then you would have to register with selective service. Now of course we always tell people in asylum who got asylum or who would come as refugees to register for green card as soon as possible so they should be doing that anyway, and they should be registering for selected service. All right what happens then when someone wants to apply for citizenship but they never registered with selective service. Well it is a issue that can come up in an interview. This is definitely one of the things you want to think about when you're applying for citizenship. You want to make sure that you can check the box that you did in fact register. Now if you go to the selective service system, and it's www.sss.gov, you can put in some information about yourself and get a determination right there, as to whether or not you didn't need register for selective service. One of the things we always do is do that for our clients and include it in the application. Now if you haven't registered selective service, and you're required to do so. There are some ways that we can work on the case, and try to develop fax that show that show either you didn't know that you have to do it, or you're unaware of it that you have to provide a reason, or explanation to the immigration service as to why you did register with selective service. I suppose if you purposely avoided registering for selective service, that would be a problem but we haven't have that situation come up yet. We have had situations where young man went here, they didn't know they had to apply with selective service and we're able to get them citizenship non the less. It's not an absolute bar to it, but it is something that you're going to need the assistance of an immigration attorney to help you sort out what the requirements were, whether you fulfill it, if you didn't why not. If you have any questions about this, or any of the other aspects of applying for citizenship. Feel free to pickup the phone and give us a call, 314-961-8200 or you can e-mail me jim@hackinglawpractice.com . Thanks. How a US citizen brings a spouse to live U.S. as a Legal resident (Green Card)

05:10
http://www.apsanlaw.com In order to bring your spouse (husband or wife) to live in the United States as a permanent resident (green card holder), you must be either a U.S. citizen or permanent resident. "Our office has assisted many thousand of couples in applying for a Green Card through marriage. We have also succeeded in hundreds of 601 waiver cases for people that have either entered the U.S. illegaly or overstayed their visa." Spouse of A U.S. Citizen Inside The United States - Adjustment of Status The spouse of a United States citizen can qualify for "adjustment of Status " while in the United States as an "immediate relative" immigrant. This can be done only if the spouse (1) entered with a visa or visa waiver program or (2) if they entered illegally or are out of status an application for immigrant status with the USCIS was filed before 4/30/01 or with the department of labor for Labor Certification before 4/30/01 or they were derivative beneficiary of a parents petition. All other spouse of U.S. Citizens that either entered illegally in the United may have to apply for a waiver of the 3/10-year bar. The adjustment of Status application is filed with the local USCIS office having jurisdiction over the Petitioner's residence. The packet is generally filed with an application for Employment Authorization and if desired with a permission to travel during the process (Advance Parole), if they have not been out of status for a period of over 6 months on the date of filing. A few months later a notice is sent directing the applicant to (1) appear for processing of the employment authorization (EAD) (2) take fingerprints (3) appear for the adjustment interview. On the date of the adjustment interview you should be granted a permanent Immigrant Visa (Green Card). The spouse may file for U.S. citizenship 3 years after the approval of the Permanent Visa (Green Card). Spouse of A U.S. Citizen Living Outside The United States The first step in establishing your eligibility to immigrate to the United States is to have your U.S. citizen spouse file an Immigrant Visa Petition with the office of the U.S. Citizenship and Immigration Service (USCIS) having jurisdiction over his/her place of residence. Petitions Required to be Filed in the U.S. -- File the I-130 petitions at the USCIS Service Center having jurisdiction over their place of U.S. residence. Filing Petitions Abroad - Petitions, Form I-130, which can be filed abroad, are limited. Petitions for immediate relative immigrant or 1st preference petition classifications can be filed abroad by American citizen petitioners who have been authorized to be continuously resident in their consular districts for at least the preceding six months, including members of the U.S. armed forces, emergency cases involving life and death or health and safety, and others determined to be in the national interest. Petitions are filed with USCIS abroad or at the U.S. Embassy or Consulate (when there is no USCIS presence). If the U.S. citizen parent (the petitioner) presently resides abroad, s/he can file petition by post to the USCIS office at the Embassy. Proof of residence in the country is required If the petition is approved, the petition will be forwarded to the National Visa Center and will eventually send the approved petition to the Immigrant Visa Branch at this Embassy for further processing of the visa. If your U.S. citizen spouse resides in the U.S. s/he should file with the USCIS office having jurisdiction over his/her place of residence in the United States. The processing can take several months. USCIS will send the approved petition to the National Visa Center (NVC) for further processing NVC plays an important role in the U.S. immigration process. NVC provides instructions to petitioners and sponsors, and receives from sponsors, the required Affidavit of Support forms, fees, other required documents, and much more. For numerically limited family preference petitions, NVC contacts the petitioner once the petition's immigration wait nears end, and the priority date is about to come current. The NVC will send you a package to prepare. This package contains all the vital information needed to approve the Permanent Visa (Green Card). You will send the completed package to the U.S. consulate were the parent resides. The U.S. Consulate will notify you of the interview date and the address for the medical exam and fingerprints once the priority date become current. Accompanying Children If the child of the spouse of the United States citizen has a child and if their marriage occurred prior to the child's 18th birthday, the U.S. citizen can file a separate petition as a stepfather of the wife's child. The child's case will be processed similarly to the mother.

2017 How to check your immigration case status USCIS create an account on My USCIS

09:20
The official USCIS website is https://www.uscis.gov/ You can check your immigration case status here: https://egov.uscis.gov/casestatus/landing.do But I really suggest you to create an account under "My USCIS" click here to create an account: https://egov.uscis.gov/casestatus/disclaimer.do Once you create account account on My USCIS, you will be able to receive any updates on your application via text and/or email address. I was able to get alerts on my account on July 17, 2017 for my Naturalization petition Form N-400 directly to my phone number via text message, and I also got an email notification about my case status. USCIS usually update their processing time information every 18th of each month. but instead of constantly checking for updates on your immigration case, why not just sign in for an account on "My USCIS" turn on text and email alerts, and you will be notify of any changes on your immigration case. Starring: Holly Conroy, Allan Lazo, Dan Tanneh, Jenifer Spenser, Joe Barcelone Director: Renato Asuncion Copyright Shah Peerally Productions Inc. Every year thousands of immigrants apply for American permanent residence through marriage. There are many immigrants in the US, some staying legally, many others illegally too, most of them want to stay over in the US and receive a green card. Green card through marriage is a commonly tried and tested method; where marrying an American citizen makes the spouse qualify for a green card and ultimately citizenship, which of course has to be approved by the immigration authorities. For this the beneficiary and the petitioner both have to go through an interview at the immigrations office, where they have to prove the authenticity of their marriage. Since many years now Immigration has become a sensitive issue with plenty of queries being raised about the kind of people who have been migrating to the US. And while there is a lot of skepticism in the minds of US citizens about the need to grant addition citizenship to many immigrants, there are other concerns which are based on issues that veer towards racism, astoundingly in a Through their films the Shah Peerally Productions have always spoken about the concerns of the people. It is a curious situation that the viewers are presented with in the film when Holly and Victor meet Bill Benet, Jenifer Lawrence and Dan Jones, Department of Homeland Security USCIS Officer, Department of State Officer and FBI Special Agent respectively. The interview that follows is an extremely intricate scene in the film. It shows many shades and angles of what actually goes on, often within the confines of such interview sessions in the USCIS offices, how people react, motives, challenges and often opinions of the State versus the people. Holly and Victor are a married couple, Holly is the petitioner in this case seeking a citizenship for her husband through marriage. While this is common in the country, because of plenty of cases where people have misused this right leading to defrauding the government with a sham marriage the immigration officers have become very vary of such cases. As is always the case in such instances, it is very difficult to judge a false case from an authentic one. The fine lines between suspecting immigration officers who think Victor is using Holy and the couple who seem to be in love, is beautifully brought out in the film. In the end we see a lot of confusion between the couple, one must also grant the fact that they are like any other couple in such a situation under a great deal of stress and actually break up under the tension. Holly and Victor face the interview under stress and they seem to not only crack up but not tuned into each other too in many ways. What also comes through shockingly is the assumption of the officers and how they are determined to decide the fate of the petition even before the interview is over. The film not only talks about the realities of life and immigration policies, rules and ways in which people use immigration policies as well as the attitude of the officers, it also teaches people about how they should be prepared for such interviews, face different situations and how they should never lie to the authorities. How DevOps Can Fix Federal Government IT The Federal Government spends more than $80 billion each year on information technology. As the fiasco with healthcare.gov demonstrates, the results are not always good. Government IT programs are expensive and monolithic, and the lead time from a “mission need” to a deployed capability is often measured in years (in one of our agency’s programs, about 12 years!). IT systems are often difficult to use, and the US government’s online service offerings to citizens are far from meeting the expectations of a public that is used to Google, Facebook, and Twitter. The US government has only recently begun to adopt agile approaches, and only in a few agencies. But the results have been encouraging, and show that it is possible for the bureaucracy to be agile. DevOps, however is a game changer. At USCIS we have moved to a continuous integration, continuous delivery approach, and have begun experimenting with a DevOps model tailored to the needs of the government. By combining DevOps with some ideas taken from the Lean Startup movement, I believe we can cause a radical change in how the government does IT. We can dramatically reduce lead times and costs, improve the usability of systems, provide more transparency, create citizen-centric online services, and – importantly – significantly improve the government’s security posture.
