Excellent and informative video. There is one point. If I take a case out against someone and they reply with a defence of what they did was right, and I then answer that defence with known facts, and the defendants then stop corresponding, what would be a reasonable time limit to ask the court to ask the defendants to reply? I understand that 28 days is the maximum for defendants to submit to their first response, but after that I cannot find information on.

Hi Miles. It would really depend on a number of factors including, the nature of the case, any operative precedent case and even the jurisdiction in which the matter is being heard.

they also tried to tell me not to use a solicitor while they were robing my house! blocked my access to view what i wanted to watch on the internet! tapped my phone line! block me from using my my mobile phone! (i no longer use or trust any devices other than my last working computer which has also been hacked) I'm sorry, i would go on but i took up smoking while this all happened and i need more cigarettes to deal with the stress of it all!

Jazz Shephan under the Occupiers liability act 1957, occupiers owe a duty to keep their visitors (people with permission to be there) safe. Under Occupiers liability act 1984 it covers the need to alert trespassers of the danger and keep them safe although it's held to a lesser standard than the 1957 act. :)

I need some detection towards information. I am working on a fact pattern assignment that might involve contributory/comparative negligence and non economic damages cap. I live in Hawaii and unfortunately on westlaw many opinions are out of plan. I am aware of the Contributory Negligence Act of 1945 but is there any other history that might guide me? In the fact pattern the estate is asking for 10 million dollars.

Hi Mellyssa. It depends on the type of rescuer. For instance, if it's a firefighter, then yes. However, much like in Chadwick vs. British Railways, if it was a bystander who 'volunteered' to help, then technically no. Having said that, the Law tends to look favorably at granting relief for such parties in considering the selfless nature of the act as well as to foster the same habit among others.
